Jack Perks (the “Trainer”, “we”, “our”, or “us”) owns and operates the mobile application Jacked Dadbod (“App” or “Platform”), which enables Trainers to provide training, coaching, and nutrition guidance to their clients. The App is developed and maintained by FitBudd Inc. and its subsidiaries (“FitBudd”).

We respect your privacy and are committed to protecting your personal data. This Privacy Policy explains how we collect, use, store, share, and delete your information. By using the App, you agree to this Privacy Policy. It complements our Terms of Use and applies to all Users of the Platform.

When you register, we may collect your name, age, gender, email address, health-related information, and photos for fitness progress tracking.

2.2 Financial Information

We collect payment details (such as credit/debit card information) solely to process subscriptions or Fees. This information is handled securely by third-party processors and is not stored by us.

We collect device information, browser type, referral sources, pages accessed, and interactions within the App.

2.4 Location Data

If provided, location details (e.g., city or postal code) may be used to personalise Services or improve App features.

3. How We Use Your Information

We use your information to:

  • Personalise your experience
  • Track fitness progress, workouts, and meal plans
  • Respond to support requests and communicate updates
  • Detect and prevent fraud, errors, and abuse

3.1 Refund Abuse Protection
Users who access content during a free trial are not entitled to refunds for downloaded programs or Services if they cancel after using the trial period. Misuse of trial offers (such as repeated sign-ups to bypass payments) may result in account suspension or termination.

4. Sharing and Security

  • We do not sell or rent your personal information for marketing without your express consent.
  • Your data may be shared with FitBudd, service providers, affiliates, or contractors to deliver and improve Services.
  • We implement standard security measures (e.g., SSL encryption) but cannot guarantee absolute protection against unauthorized access.

5. Intellectual Property

All App content, including logos, trademarks, videos, and programs, is owned by the Trainer or properly licensed. Users may not reproduce, distribute, or exploit Content without prior written permission.

6. Acceptable Use

You agree not to:

  • Attempt unauthorized access to the App, accounts, systems, or networks
  • Disrupt or interfere with Services (e.g., spamming, hacking)
  • Send unsolicited marketing through the App

Violations may result in account termination and legal action.

7. Emails and Communications

Neither the Trainer nor FitBudd is liable for injuries or damages resulting from participation in Services or App use.

The App and Services are not regulated by HIPAA. Users do not receive HIPAA protections when using the App.
